TERMS AND CONDITIONS

Digital Products

This Agreement (“Agreement”) is made effective by and between Moon Bunny (the “Company”), and purchaser of the digital product (hereafter “Client”), for the purpose of Client purchasing a digital template product from Company’s online shop (the “Product”). Client agrees to the terms and conditions below by checking the box in the online shopping cart checkout or by submitting payment for the Product.

 

1. Digital Product Usage 

After purchasing the digital product, Client will be given access to the product materials in within [48 hours] through a download delivered in his/her email. Client will have lifetime access to the materials so long as the product(s) is/are available.

Company hereby grants to Client one (1) exclusive, non-sublicensable, non-transferable, license to use the Product. Client understands and agrees that the Product materials may not be shared with any third party. In the event Company suspects that the Product is being shared with another party, Company reserves the right to immediately terminate Client’s access to the Product.

Client may use the Product for his/her own personal use and business use and may modify the language as he/she sees fit. Client is not obligated to tag or give credit to Company for the copy in the Product he/she uses, posts, or shares. 

2. Fees & Payment Processing 

In consideration for access to the Product provided by Company, Client agrees to compensate Company the fee indicated on the online shopping cart. If any payment methods are declined by the online payment processor, Client shall provide a new eligible payment method before receiving access to the Product.

 

In the event Client has already been given access to the Product and a payment method is declined, Company reserves the right to collect any and all outstanding receivables.

3. Refund Policy 

Due to the nature of digital products being immediately accessible upon purchasing, no refunds of any fees or other amounts paid by Client in connection with the Product will be allowed under any circumstances.

4. Personal Information

By purchasing the Product, Client will be asked to provide personal information including his/her name, email address, mailing and billing address. Client agrees to allow Company access to this personal information for all lawful purposes. Client is responsible for the accuracy of the identifying information, maintaining the safety and security of his/her identifying information, and updating Company on any changes to his/her identifying information.

The billing information provided to Company by Client will be kept secure and is subject to the same confidentiality and accuracy requirements as Client’s identifying information indicated above. Providing false or inaccurate information, or using the Product for fraud or unlawful activity, is grounds for immediate termination from the Product.

5. Copyright


Upon delivery of the digital product to Client, Company hereby transfers and assigns to Client all copyrights regarding the Product.

6. Warranties and Liability 

Company makes every effort to ensure that the Product is accurate and fit for the use of Company’s customers. However, Company takes no responsibility whatsoever for the suitability of the Product, and Company provides no warranties as to the function or use of the Product, whether express, implied or statutory, including without limitation any warranties of merchantability or fitness for particular purpose.

 

Client agrees to indemnify Company against all liabilities, claims, demands, expenses, actions, costs, damages, or loss arising out of Client’s breach of these terms and conditions. Company shall not be liable to Client or any third party for consequential, indirect, special or exemplary damages including but not limited to damages for loss of profits, business or anticipated benefits whether arising under tort, contract, negligence or otherwise whether or not foreseen, reasonably foreseeable or advised of the possibility of such damages. 

7. Guarantees 

Company does not make any guarantees as to the results, including financial or other personal gains, of Client’s use of the Product. Client agrees to take responsibility for Client’s own results with regard to using the Product.

9. Release & Reasonable Expectations 

Client has spent a satisfactory amount of time reviewing Company’s business and has a reasonable expectation that Company’s Product will produce different outcomes and results for each Client. Client understands and agrees that: 

▪ Every client and final result using the Product is different;

▪ The Product is intended for a mass audience.

Physical Products

Return Shipping Costs Please note that we don't cover return shipping costs at this time

Exchanges (if applicable) We only replace items if they are the wrong size, defective or damaged.

If you need to exchange it for the same item, please send us an email at customerservice@buyability.co.za with the subject [Exchange goods - Items Purchase – Your Full Name and date of purchase].

Please include your full contact details as well as your reason for the exchange. Based on the approved process being followed to obtain the exchange request, we will require the items to be shipped back to us within the 7 calendar days with the item being unused, in the same condition that it was received and it is in its original packaging.

We strive for the highest quality of the products we sell. We want you to be happy with your purchase. If you are not completely satisfied, you can return the product to us. We strive for world-class customer service so all returns are subject to the terms and conditions listed below.

Failure to adhere to any of these requirements could delay the processing of your request or result in its decline altogether.

Our returns policy is strictly 7 days consecutive days. If 7 calendar days have elapsed since you received the item, unfortunately, we can’t offer a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Such as, but not limited to, intimate wear; underwear or Lingerie; as well as swimwear (like costumes).

To complete your return, please contact customerservice@buyability.co.za with the subject [Return - Items Purchase – Your Full Name and date of purchase].

Please include your full contact details as well as your reason for return, preferred outcome (exchange or refund request) and our customer service team will be in contact to walk you through the returns process or advise you further.

Based on the approved process being followed to return the item, we will require the item(s) to be shipped back to us within the 7 calendar days with the item being unused, in the same condition that it was received and in its original packaging.

When your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If your refund is approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 7 – 14 working days.

Shipping/ delivery costs will not be refunded.

Refunds are only applicable to the approved returned product items received. 

A notice of confirmation will be sent to you notifying you that the refund has been processed.

Late or missing refunds (if applicable) If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted.

There is often some processing time before a refund is posted.

If you’ve done all of this and you still have not received your refund yet, please contact us at customerservice@buyability.co.za

We want you to be happy with your purchase however when it comes to personalised items (where you have supplied your own design or perhaps altered/ added custom text to one of our designs), it becomes very difficult to accept return items as we cannot re-sell the item.

We, therefore, please urge all clients to request a size chart for Shirt and Hoodie size confirmation prior to the order, so that custom orders are a suitable fit.

Return Policy on Personalised and Customized:

We cannot accept returns or exchanges for any Custom or Personalized printed items unless the products are damaged or defective upon arrival.
If there is a misspelling or error in the printed design, due to a mistake by BuyAbility we will allow the return or exchange.
Cancellation of personalised orders that have already been sent for production, where the personalisation process has already been completed, you will only be offered a 50% refund.
